I seem to remember an issue coming up before on this topic.  (I've forwarded the thread to the ESIP & AGU ESSI mailing lists, as I think that's where it was).

They also had a question of what would be the restrictions on data that's derived from the original data ... especially as it had implications for people to be able to peer-review their research, if the data that it's being based on isn't available to the reviewers or the wider community.
